I filed a Mechanic's Lien on a job for our Customer to push for payment

CaliforniaLawsuit

Our customer asked us to file since our intent didn't work. He requested we file a lien to help push for payment. They have now paid us in full since the Mechanic's Lien did not work to push for payment. Now that our customer has paid us in full and we were running out of our lien rights, the ninety days has expired from filing the lien. My customer doesn't want us to do a Release of Lien since they still have not been paid, but don't we by law have to do a release of lien since we did not file suit after the 90 days of filing the Mechanic's Lien?

If I understand your summary correctly, there are two reasons why you must now release your lien: (1) your customer has paid you for the debt that is the subject of the lien; and (2) 90 days has passed since your lien was recorded. For either reason, you should now release your lien. --CN
