I filed a mechanic's lien in Florida. The company I worked for has offered me a settlement. Their terms is for us to get the lien released and then come to their office and they will pay us. Should we release the lien first?

We used Zlien to file a mechanics lien for us in Florida. As soon as the lien was recorded the General Contractor, whom we worked for, contacted us and has offered us a settlement. Their condition for this settlement, is that they want us to go to the county and release the lien first and then bring them that document and they will pay us.

That's great! I'm glad we could help. Florida has a statutory provision for just this situation. A lien release must be in substantially the same form as required by § 713.20 of the Florida mechanics lien statute. However, under § 713.20(7), a lienor who executes a lien waiver and release in exchange for a check may condition the waiver and release on payment of the check.
