I didn't file the nonpayment notice is my mechanic's lien still good and can I still collect on it?

Florida

I filed a mechanic's lien and all the correct paperwork but missed the deadline for filing the nonpayment because I thought we were good for a year now. Now I have 6 weeks until time to enforce the lien but it says I missed filing the nonpayment portion, am I still going to be able to enforce the lien or collect on this debt?

There is not enough information to give an answer. I recommend that you contact one of the lawyers on Levelset's Florida page in the geographic area of the project to review your situation.

What do you mean by "filing a nonpayment"? This doesn't sound like an actual requirement of the lien law; it sounds like one of those forms like a "notice of nonpayment" that's used to try to get people to pay like a formal looking legal document, but which isn't actually required by ch. 713. Mr. Bass is correct. If you have 6 weeks before the year runs out, talk to a lawyer asap.
