Florida mechanics lien claimants will be entitled to file a mechanics lien even if there's a dispute over what they're owed and even if the owner claims they need to perform some repair work. Granted, if a lien is filed, then the owner would absolutely have the ability to challenge that lien based on issues like damage to their home. And, if an owner successfully disputes the validity of the claim, they may well be entitled to damages, etc. When in a standoff over final payment, negotiating and reaching some middle ground might be a good way to avoid making full payment while also avoiding a lien on your property. Or, if the dispute has become more adversarial, sending a demand letter might make sense. Officially and formally demanding that the claimant repair the work might get their attention, especially when sent via attorney letter. What's more, demanding that the claimant stand down and refrain from filing their lien claim could be useful there, too. In addition to the above, I think these two articles may be helpful: (1) I Just Received a Mechanics Lien Threat – What Should I Do Now?; and (2) A Mechanics Lien Was Filed on My Property – What Do I Do Now?
