I am the buyer of windows on 10/22/2018. Contractor has not followed through with promises of delivery dates. What should I do?

I ordered 2 windows from 1st Choice Windows and Siding. Their address is 10273 Kenneth Drive, Parker, CO 80134. Contract price is $6148.00. I put a deposit down of $2500.00. The contractor promised me that the windows would be installed in November 2018. The contractor did not set up a delivery date with me. He stated, "I don't have the exact installation date because your windows are special order". I called around the 3rd week in November. He stated the windows where delivered to him but the company was very busy in December and therefore he could not set a date for installation. I received a call from "Brandon" who stated he would be at my home today at 0830. he never showed up. I plan to cancel my window order. How can I get my deposit of $2500.00 returned to me?

I'm sorry to hear about that. The first order of business may be to review the contract signed/order placed for the terms of the agreement. Typically, there will be some language present to provide guidance on how to cancel orders and obtain refunds. Further, if they have a website, that language may be present there as well. Another option should be to call the contractor and discuss the cancellation of the order and a refund - talking it out is almost always a preferable option to taking some official action to try and force action. Of course, if necessary, sending an official demand for the refunding of payment could do the trick - and sending such a demand via an attorney letter can provide extra "umph". But again, discussing the matter with the contractor or abiding by the terms of the agreement that relate to cancellation and refund might be the path of least resistance toward obtaining a refund.
