How to remove a lien?

MichiganLien Releases
Anonymous Contractor

We have a lien on the house from 6 years ago. Nothing has ever been done on it - no contact with lien claimant, no court proceedings. This seems like it's outside the lien enforcement limits. The Discharge form needs to be submitted by the claimant, but I have no contact with them. How do I go about removing the lien?

The removal of a Michigan mechanics lien after it has expired is covered by Mich. Comp. Laws §570.1128. Under this statute, you may present the lien recording information to the county clerk's office of the county where the claim was filed. This includes an affidavit of when the lien was filed, and the name of the all parties listed on the lien claim. The clerk will determine if the claim has expired, and if so, issue a certificate to be recorded in the office of the register of deeds in the same county. Once filed, the claim will be removed.
