How to file with the court to remove the lien?

A company filed an invalid lien on a botched granite counter job after I called them to get the issue resolved and then ignoring my calls for months. They did not correct the major mistakes made on the job and filed after the 90 day period after installation. I need to get the lien removed as the property was sold before they placed the lien. I don't want to hire an attorney as it would cost more than what they say I owe. My invoice states I owe $500 but they are claiming $1600. I have proof that it the filing was after 90 days, there was no contract with statutory language. Just want to file with the court to prove my case and have the lien removed on a house I already sold. Please help.

Michigan Construction Lien law has two relatively easy procedures to remove the lien depending upon the facts. If the lien is more than 1 year old, it can be removed by filing an affidavit that a foreclosure of the lien has not begun (and thus it is invalid). If it is less than 1 year old you can remove the lien by placing 1 1/2 times the amount claimed in the lien in escrow with the court. Then the closing can take place and then you wait. You will get your money back if the contractor does not file to foreclose on the lien. Keep your proofs and hire an attorney if the contractor tries to foreclose on the lien.

Thank you for responding. It has been less than 6 months since the lien was filed. The lien is invalid and the house has already sold. Is there an affidavit I need to file to remove the invalid lien in my name on the house in the new owners name? Thank you
