HOW TO FIGHT A FALSE LIEN ON HOME

I REQUESTED AN ESTIMATE TO REPAIR/REPLACE MY ROOF. I RECEIVED AN ESTIMATE HOWEVER NO WORK WAS DONE TO MY ROOF BUT THE CONTRACTOR FILED A LIEN. I CONTESTED THE LIEN, AND WANT TO KNOW IF I SHOULD FILE A POLICE REPORT AS THE LIEN IS FALSE? ALL THE ROOFING CONTRACTOR DID WAS CALL MY HOA, AND THE HOA TOLD THEM TO GET INFO ON ROOF DELINEATIONS FROM PALM BEACH COUNTY BUILDING WHICH IS CUSTOMARY.

This forum is for contractors. The notice of lien contest requires the contractor to file suit within 60 days or the lien will expire. If no work was done the lien is invalid. No lawyer will take that case.

A lienor has 60 days after you record a Notice of Contest of Lien to file suit against you. If no suit is filed, the lien is nullified by action of law, which means that you don’t need to do anything further. If suit is filed, call a construction attorney immediately.
