How much do you charge to enforce a Lein?

I'm in New Haven CT. and I would like to enforce a Mechanical Lein. How much are your services and what is the process and total costs?

If you're talking about liening a project, it is not particularly expensive (approximately $500.00 at our firm). If you're talking about foreclosing upon a mechanic's lien already filed against the project, then it will be more expensive, as you must start a lawsuit and it will depend on the facts, circumstances and the amount of the mechanic's lien. If the lien is for a small amount, it might not be worth your time or money to foreclose, but there are other strategies you can implement to try and collect.

I agree with Attorney Brown's answer. First off, was the mechanics lien properly filed or are there going to be challenges to it by the property owner? Is there still time left to file a lawsuit to foreclose on the lien? Are you the only lienholder or are there others with liens on the property? Are you a subcontractor and, if so, was the GC paid in full? If so, then your lien against the property would be dischargeable and your recourse would be against the GC. What about other liens or mortgages on the property? If filed before yours, there might not be any equity left for you. As you can see, there are a lot of variables. And lawyers handling foreclosures are paid by the hour. So, unless the mechanic's lien is a large amount, it might be better to try to informally negotiate payment.
