How long does the customer have before I can lien the property?

I just sent an invoice for the final payment on a job in California. I suspect that I am going to have a difficult time receiving payment. How long does the customer have until I can lien the property?

Assuming you either sent a preliminary notice or are directly contracted with the Owner, you have 90 days to lien the property after the project is over or 30 days after a notice of comletion gets recorded. The timelines are pretty strict. If the lien doesn't get you paid, you'll have to file a lawsuit to foreclose on the lien--and that has some timelines too.

Once the money is owed, you don’t have to wait any time to file your lien. You can file it right away. Some contractors give the customer around 3-4 weeks to pay but that’s not required. You only have 90 days from the lien recording to file your lawsuit to foreclose the lien until the lien expires so you don’t have a lot of time. I’m happy to answer any questions you have about this.
