How long do I have to file a construction lien?

Georgia

I have a customer who still owes over $6000 from a roof we installed on 7/25/22. We have been in contact with him an he keeps telling us he will send a check but hasn't.

Peter - In Georgia, you have 90 days from the last day services were performed on the property to file a mechanic's lien. If your last day on the project was July 25, 2022, then your deadline for filing a valid lien would have been October 23, 2022. Although it appears you may missed the deadline for filing a lien, you are not precluded from filing a lawsuit to pursue the outstanding balance owed.

It is too late to file a lien. You can sue him in small claims court without a lawyer. That is probably your best bet because the attorneys’ fees would be a large portion of the debt.
