How easy is it for someone to file a mechanics lien against your property?

I hired a person to do work on my rental house, since I put it up for sale. We don’t have a written contract, but on multiple times he told me the job would be completed weeks ago, since I have a contract on it. Lastnight he called me, yelling that he wants his money, even though he’s not finished with the work, and has since remembered the scope of the agreed upon work much differently than what was Initially agreed to. He kept telling me it was going to cost me more money because he didn’t realize it was going to take him that long to do, etc. I have completed part of the work myself, since he keeps not showing up, and when he does show up, it’s for maybe an hour or so here and there. He called me making threats that he will file a mechanics lien on my home and get more money from me that way, if I dont give him more money. And said it would cause me to lose my sale on the house. Can he file a mechanics lien on my house, when he didn’t complete the work, and I actually overpaid him, based on what work has been done, and what is left to do, which I will have to hire someone else now to finish.

Hello. It is very easy to file a lien. It must be done to the letter and include the notice of intent. One critical issue here will be the amount of the lien. If the amount is incorrect your attorney could file an action to have it removed and for your attorney fees and costs. In short, if a lien is filed reach out to an attorney ASAP for advice and assistance on the matter and to remove, if possible.

Someone can file a lien for work performed. This is true even if you disagree that the work was proper or appropriated. I would not worry until/if the lien is filed and perfected, then call for help.
