That's definitely an interesting one, and I suppose the first order of business might be to be sure you're safe from any physical threats. Anyway, there are a few options for demands prior to the actual filing of a lien - and zlien has a number of templates that might be of service. One of the most common documents demanding payment prior to a lien filing is a Notice of Intent to Lien. This document serves as a sort of warning shot - it states that if payment isn't made, the claimant will file a mechanics lien. Plus it's (relatively) low risk since it doesn't actually encumber the property and is cost effective. You can download a free copy of that form here. Next, sending a good old fashioned demand letter can be fruitful. A demand letter can really be anything a claimant wants it to be, but they'll typically contain notice that if payment isn't made, legal action will be taken (like a breach of contract action, a claim for unjust enrichment, or even a small courts claim, for example). Utilizing an attorney for sending such a demand letter can help to raise the stakes, too. For another option, zlien has free downloadable forms for things like "Notice of Potential Breach," "Demand for Payment," and a "Notice of Incomplete Payment", among other available forms which you can find here. Lastly, if a mechanics lien does become necessary, feel free to take a look at this practical guide to filing a California lien, and this downloadable California mechanics lien form. Good luck, and be safe!
