I will be administering the payment of funds to subcontractors on a job and want to know what/if waiver forms are required in exchange for payment and how do I protect myself for liens

The best way for an owner to protect against mechanic's liens is to pay the bills in a timely fashion. No money owed, no liens. The Legislature has established four types of statutory waivers and releases forms to be used to waive and release lien, bond and payment rights during and after construction. They are: • Conditional Release upon Progress Payment • Conditional Release upon Final Payment • Unconditional Release upon Progress Payment • Unconditional Release upon Final Payment These statutory forms are to be used by all contractors, subcontractors and materialmen. They should not be modified in any significant respect. A conditional waiver and release is conditioned only upon presentation and payment of the check by the bank upon which it is drawn. Unconditional waivers and releases should be used only when the contractor or material supplier has previously been fully paid by checks which have already cleared or is being paid in cash, cashier's check or wire transfer of funds. As an owner, you should be obtaining the waivers when you are issuing checks and asking for them after the check clears.

Oh if it was only that simple! Unfortunately an owner can pay their GC and still get a lien filled on their property by one of the GC's subs when they don't get paid. So how does an owner protect themselves against this risk? The GC of course needs my payment to pay off the subs, and if I pay him I have no way to force him to use the money to pay the sub. A Conditional release does me no good if the GC does not then pay the sub right?
