How do I submit my finalized monthly payment application IF ownership hasn't responded within 12 days of receiving??

NYC Contractor submitting to ownership for payment... If they do not respond with revisions or give their approval within the 12 days what happens next? Can we finalize & submit the pencil copy as is?

Under the NY Prompt Payment Act, the payment application you submitted may be considered approved if they do not respond in a certain amount of time. That could be governed by the law itself, or by your Contract depending on what your Contract says about the timing of approval of your payment applications. If you only submitted a pencil copy and identified it as such, then, to cover yourself, you should consider submitting that application in final form. If the Owner continues to ignore it, you may have rights under the NY Prompt Payment Act and under the NY Mechanic's Lien law that could be used to collect the outstanding balance.
