A great place to start when looking for a property’s current owner is the assessor for the county where the land is located. They will often have current ownership information listed free of charge, although recent transactions may not be reflected. Many assessors provide online access to their records, but some may require use of an in-office computer. Montana’s State Library also maintains their own interactive map with some data, though information found here, as well as the assessor, should be verified further. Once you have some owner information and a brief description of the property from the assessor, it’s always a good idea to visit the county recorder’s office. Here, you are able to search for any legal documents that exist in the county’s official records affecting the property’s title, like deeds, mortgages, and other liens. In Montana, this office is commonly referred to as the Clerk & Recorder. Some provide online search tools, though a few are subscription based or are limited to the index information only. For those counties, it may be necessary to go to the office in person or pay a nominal fee to obtain a copy of the document you’re looking for. Looking through the county’s official records will help you determine if the owner listed on the assessor is still current, or if the property has been transferred to a different owner. Your search of the county records may even reveal additional liens filed by others on the same project. However, if you live far from the county’s offices, need a little help verifying information, or just don’t want to deal with the hassle of filing yourself, there are other ways to file a mechanic’s lien. Construction attorneys and filing services, like Levelset, can help locate and confirm information and get your document recorded.
