How do I get a lien removed from my property? Is it different if the contractor is no longer in business?

More than 3 years ago, a contractor put a lien on my house. We had agreed through texts and emails on the cost of the deck he was putting on my house. He was going over budget by thousands of dollars without checking with me. When I refused to pay more than the amount we had agreed on, he put a lien on my house. I have no current plans to sell my house but I would like to have the lien removed. I am not sure if he is still in business. I would appreciate any info you provide.

Liens are only good for so long. While it may cause a hiccup should you want to refinance or sell, generally speaking, a lien that old is not going to be effective unless action was taken on it. If you want peace of mind, there is a mechanism (all done on paper) in the court system to remove that lien with an order. Feel free to call our office to discuss. 720-500-7855.

The lawyers at any title co. will see the lien is stale (over 1 year) and of no effect and issue a policy over it. The fact that it's on your title is legally insignificant. There is no need to bond around, spend any money w/lawyers to remove the cloud b/c it has no significance.
