FloridaLien DeadlinesLien Foreclosure
Anonymous Sub-Subcontractor

We filed a Lien on a project last November - lien HAS NOT been satisfied and expires on 11/9/2022. I keep seeing info saying I need to file action to enforce the lien but no direction on how to enforce it

Before the lien expires you need to file a lawsuit against the owner in the county where the property is located to foreclose the construction lien. You likely also have claims for breach of contract or unjust enrichment, etc. You should contact a construction attorney in your area right away.

Enforcing your recorded construction lien within the year of recording refers to filing the lawsuit to foreclose on the construction lien. If you do not file the foreclosure action, or wait to file suit after the year, you will lose the ability to enforce your lien, although you still likely will have contractual and/or equitable claims for the non-payment.

You have to file a Lis pendens with the court to enforce your lien and get a judgment in your favor.
