Im a contractor working on an HOA property where I am having trouble collecting payment. I am thinking of putting a lien on the property and want to ensure that I lien the property the proper way. The hoa contains 53 units. How do I lien the HOA without liening every individual unit?
You would file the lien in the same manner as if it were an individual property. You need to determine the true owner and a description of the property. This will require you to perform a title exam. If your work was limited to common area, it sounds as if the lien would be filed against the HOA, which may be a little tricky because you'll need to determine who is supposed to receive notice. If the HOA is incorporated you should be able to obtain this information from the Secretary of State. However, if you also performed work for portions of individual units that are independently owned, you may have the right to lien those units as well.
