How do I combat a lying cheating (T&M) contractor that placed a lien?

I have a licensed contractor that billed me hourly and overbilled. For example he billed 13 hours to install a window that should have taken 1. Other workers told me he was lying and cheating. When asked for timesheets he did not respond and instead filed a lien. Also he filed a 2 liens...one for services. The other for untendered windows that he purchased. After 60 days he produced timehsheets all in the same pen and signature. How do I combat this?

Are you a homeowner or a GC? If a homeowner, you have a number of statutes that you can use to potentially get 3x damages and attorney's fees back. If the lien is improper initiating a suit for clouding title would be the next step. If GC, he would have had to follow the stautute as a sub so his lien would be improper. If he is in fact lying you can always maintian a legal demand to with draw threatening among other things fraud. Give my office a call. 260.782.1712.
