How do I collect my $40,000 retention?

I have a 40,000 retention still out on a building I did 3 years ago Every time I contact the office they just tell me the building is in litigation, but it has been 3 years, what are the laws on this?

I'm sorry to hear that. While Washington's rules for retention have vague deadlines, 3 years is very likely far beyond what is allowed by law. However, if the project was completed 3 years ago, the Washington deadline to file a mechanics lien has passed - in Washington, a Claim of Lien must be filed within 90 days from the date services, labor, or materials were last delivered to the project. However, other routes of recovery - such as filing an action against the nonpaying party in court or attempting to bring the dispute to arbitration or mediation may still be available.
