Help with DOES or DOES not on conditional and unconditional waivers

MichiganLien Waivers

need help with knowing how to tell if you circle DOES or DOES NOT on partial conditional and partial unconditional waivers specifically. Everyone seems to be all over the map on which is correct, so I want it clarified to create unison moving forward.

The answer is that it depends. It is a fact dependent statement. If all all amounts due AS OF THE DATE OF THE WAIVER (so not including future amounts to come due) are included, then circle DOES. Otherwise if there are other amounts due an owing check DOES NOT. This waiver, together with all previous waivers, if any, (circle one) /does/ /does not/ cover all amounts due to me/us for contract improvement provided through the date shown above. This waiver is conditioned on actual payment of the amount shown above.
