A lien foreclosure lawsuit is complicated district court action that requires that you serve all proper parties. You can reach out to a construction attorney today to see about filing a suit but they must order a foreclosure certificate for proper service to the defendants. The exact timing of when you must file a foreclosure lawsuit depends on many more factors than just it being six months. It depends on the exact project and the exact circumstances as to that project.

If you cannot timely file a foreclosure suit, you still have plenty of time to sue unless your contract has a specific waiver of statutes and you agreed to that.

In short, I strongly advise that you contact a construction attorney today if possible and pay for their advice so they can review and advise on this ASAP.
