General Contractor Mechanics Lien

We are a GC and we had a job in San Rafael. Its been since about May and we have still not received our retention money from the owners of the job. My boss is under the impression that as the GC the normal time frame to file a Mechanics lien does not apply to the GC? We are just wanting to know if thats accurate and what options do we have on this issue. I called the bank lender for the project they are not showing on record a notice of completion.

Good morning, Assuming the project work has been completed since May 2019, you may have a timing issue with recording a proper mechanics lien. Are there other direct contractors still on the project or any other work ongoing of any sort?  The date of "completion" that triggers he 90-day window to record a lien (when there is no notice of completion) is tricky so you should definitely seek construction counsel ASAP to guide you with your options.
