For an HOA, what lien options are available for nonpayment of assessments and/or fines.

In the case of a homeowner's association, what are the options for filing a lien for unpaid assessments and/or fines for non compliance with covenants? Is this a statutory lien?

Most Declarations, also known as CC&Rs, that govern HOAs have language allowing the Board of Directors, or other authorized person, to file a lien against the person's property who is delinquent in their assessment payments or otherwise owe the HOA money. The language in the Declarations must be strictly followed. It's usually a good practice to work with the unit owner and let them know you intend to file a lien since they are your neighbors. The HOAs attorney should then perform the filing and recording with the County.
