filing a lien in nyc for fabricated/furnished product/work

New YorkMechanics Lien

I fabricated some railing in NYC, I was paid a deposit, they took the railings and installed on a commercial building (i know the address, and the GC who paid them, apparently the GC owes them a balance also) I have not been able to collect my balance from anyone at this point, can we file a lien on the property? This happened this past December 2020.

as long as you are no further then owner-gc-sub-you, you may file a lien. you have other rights as well, including a demand for an accounting for project funds, under Lien Law Section 77.

Greetings. It appears you have provided material to a construction job and have not been fully paid. A materialman who has provided material to a job may file a lien or sue on the contract or both. While a contract action has a 6 year statute of limitations, the filing of the lien must be done within 8 months (unless it involves a single family house or public project) and must be forclosed (sued upon) within a year unless the lien is extended.
