File Lawsuit to Enforce Lien or Cancel Lien deadline

ColoradoLien DeadlinesLien Foreclosure

I have a lien filed but I got a notice from Levelset that we need to File Lawsuit to Enforce Lien or Cancel Lien. We haven't been paid for this project, so I need to File Lawsuit to enforce the lien. I need to hire an attorney asap to get this done. Job is located in Aurora, CO. Our corporate office is located in League City, TX. My reason for pointing this out is because our contract states that if legal action is to be taken, all court proceedings will be held in Galveston County, TX. So do I need to hire a TX attorney or a CO attorney to file this? Thank you in advance,

Since the foreclosure lawsuit relates to real property it must be filed in Colorado district court of the county where the real estate is located. You need to hire an attorney very soon as the attorney will need to order the foreclosure guarantee and do all steps before the deadline. The deadline is strict and if this is missed, that is it. You cannot foreclose on the lien.

A foreclosure suit is complicated and time consuming so you will want to talk to your Colorado attorney as to options and they can go over the expenses and timeline.
