Does the CamHome Improvement Contract ;aws requirements include contracts fo work performed by Mitigation Contractors?

Does the California Home Improvement Contract requirements include contracts for mitigation repairs from mitigation contractors. We are being told by our mitigation contractor that the California Law doesn't apply to mitigation contractors.

Mitigation contractors (ex. accident restoration companies) are exempt from having comply with Home Improvement Contract laws IF they satisfy three conditions in Bus & Profession Code 7159.10: 1) contract amount is less that $750 2) buyer initiated contact with the contractor 3) contract does not sell the buyer goods/services beyond those reasonably necessary to take care of the particular problem 4) no payment due till after completion If all of those conditions are not met, then contractor IS required to follow HIC laws including the format of the contracts provided to buyer. Watch for the upsell or price quote that potentially makes an exempt contractor fall out of compliance and turns into a non-exempt contractor. At which point, you will have to make a cost/benefit analysis whether to file complaint with the CSLB or with the contractor's bond company or with the insurance company that referred you to the contractor.
