Do we have legal rights to sue general contractor for forging our signatures on a check?

DelawareJoint Checks

We used a general contractor on a home insurance claim. We did not know about another check being issued and the contractor got more money from insurance company and forged our signatures. Can I get them for check fraud in civil court?

Sorry to hear about your situation. Forging signatures on a joint check is a serious offense. The first step would be to contact the insurance company. Not only to have them file a report for fraud with their financial institution, but also to possibly get them (and more importantly their attorneys) involved. The sooner the better, as the money transfer may still be able to be reversed. Secondly, as you hinted in the question, you can still file a claim in both civil court (and potentially criminal court as well) under the Delaware forgery and fraud statutes. You should contact a local attorney to help guide you through the process. A good place to start your search would be DE State Bar Association Lawyer Referral Service or Avvo.com. Good luck!
