Do we have 90 days from furnishing the last material to a project to file a claim on a bond?

We are a supplier for a prime contractor for a bonded public project in Georgia. The Miller Act states that if you have privity with the prime contractor that the 90 day notice requirements don't apply. I am having trouble finding on the Little Miller Act if that same rule applies in Georgia or if that is just a federal law.

The Georgia "Little Miller Act" has similar requirements, and the notice within 90 days is required of claimants who lack a direct agreement with the prime contractor. Of course, if in doubt I would always send a notice, if payment has not been made and it is close to 90 days!
