Do they have a right to keep my truck?

TexasMechanics LienRecovery OptionsRight to Lien

Ok so I let my father borrow my truck for a little while and in the process he had to do some "repairs" and actually ended up tear the entire motor apart well he could not get the computer to link up correctly and took it to a repair shop and I'm assuming did not pay because they have put a mechanics lein on my truck and as my father states are holding the truck until payment. Problem is that I did not agree to any of this being done and would just like to get my vehicle back so I can make necessary repairs. Is there anything I can do?

The right for a repair shop to hold a vehicle on which the shop has worked is set out in Texas Property Code Chapter 70, which you can review at the following link:

https://statutes.capitol.texas.gov/Docs/PR/htm/PR.70.htm

Depending on the amount of the charge, you should consider paying the charge or paying the charge under protest. It is not a defense that your father with authorized possession of your truck took the truck to a repair shop for repairs. To regain possession of the truck, the claim for the repairs will have to be resolved.

If the repair shop did not repair the truck properly, you can take the truck to another mechanic to have it repaired, and then make a claim against the first shop for not repairing the truck properly.

Good luck.
