We have a completed construction job in NC. We are negotiating a possible return for "Punch List Items". Would the punch list time extend our lien right date
That depends. It is possible that it would extend, if the original time for filing has not expired from your last date of furnishing labor or materials under your contract. North Carolina courts have set forth a 4 part test: 1. The labor or material furnished must be required by the contract; 2. The labor or material furnished must be furnished under one continuous contract; 3. The labor or materials furnished must be so furnished to perform the required obligations under the contract and not merely to extend the time in which a lien may be filed; and 4. The labor or materials must be furnished prior to the time period in which a lien may be filed elapsing originally.
