Do punch list items or warranty replacement items extend the lien deadline?

North CarolinaLien Deadlines

We have a project where we are the materials supplier. The sub had to complete punch list items in addition to replacing a failed part on a water fountain we provided. Do the punch list items and/or replacement part for the water fountain restart the lien deadline time frame?

While not explicitly stated in North Carolina's lien statute, the overwhelming majority of states do not consider remedial or punch list work to extend the last day of furnishing labor or material to the project or the completion date of the project. However, work performed due to a valid change order would likely serve as the basis for the last date of furnishing. Generally, the best practice when dealing with this type of work will be to stay ahead of lien deadlines and base them off of the completion of the original contemplated work.
