I am a general contractor in California and we are doing a residential project. The owners arent paying but we never sent a preliminary notice. Is this needed in California since we are the general contractors on the project?

GCs aren't required to serve a preliminary notice in California, except in cases where there is a construction lender or they are doing tenant improvement work under contract with the tenant

I agree. As a GC you don't need to send a preliminary notice unless a lender is involved. You'd know if there was a lender involved because the lender would have already been in touch with you and had you send them copies of your bills, contract, etc.
