Do I need to provide a bonded stop notice on a private project?

We have not been paid on a large private project, when working through the stop notice process on levelset it appears it should be a bonded stop notice. Is that correct?

If there is a construction lender, you may need to secure a bond to accompany your stop payment notice in order to compel the lender to withhold funds (it also creates a statutory right to attorney's fees for the prevailing party).

A stop notice does not need to be bonded.

A stop notice on a private project does need to be bonded, but sometimes an unbonded notice served on the construction lender can be effective. For some large private projects the owner is required to post a payment bond or other securty, which you may also be able to file a claim against. Get legal counsel ASAP if you are owed substantial funds!!
