Do I need to go after a contractor's bond first or file a lawsuit?

Washington

We built a house and the HVAC contractor is not wanting to fix the heat pump that he installed that never worked from the start. I do not have any money to hire an attorney and feel lost in this maze. I believe I should file a claim to go after his bond. Am I correct?

Going after a contractor's bond requires the filing of litigation to foreclose on that bond.

You can bring a claim against the bond, but to do so you have to file a lawsuit and serve it on Labor & Industries.

Jacob Bozeman, attorney, here. The contractors bond is not liable if the contractor themself is not liable. Typically they are jointly sued-claimed. There isn't a lot to be overwhelmed by, it's just not always easy or economical to get justice on a contractor deficiency-claim. There are avenues of recovery and an attorney Demand is often worth the $275.00 you pay for it. Small claims is also available. If we can help. Please feel free to contact my office.
