Do i have to pay the contractor more money for incomplete? Now being threated with a lien for non payment.

I had hired a contractor back in 2019 to assist with my home rebuild after hurricane Florence. we signed a contract that the contractor stated he would be complete with all work by 31 Nov 2019. All the things that need fixed are only partially complete. My wife and I have been continuously asking when the work will finish. The contractor stopped responding to any communication mid last year, we assumed that due to the contractor not responding or having any sub contractors working on our house. We have paid 30,000 dollars for work we were told would be completed. In the last couple days we have received 2 invoices asking for payment. The contractor is saying one of them was sent in 2019 for 18,000ish dollars that was never received and I'm now being told is 500 plus days over due. The second one is for 25,000 we are now being told is over 120 days past due and he is expecting more money. Do i have to pay the contractor more money for work? my wife and i have started to finish the work due to our insurance company refusing to continue paying for other living arrangements? The contractor is now threating to file a lien if we don't pay him more money.

I’d first investigate whether this is, in fact a licensed contractor. All work over $30,000 would require a license. If not licensed, he’d not be entitled to collect monies in excess of $30,000. If the contractor is licensed, and hasn’t worked at your home in 120 days, it has no legal right to file a lien at this time, as any lien filed would be untimely and unenforceable.
