Do I have to file a preliminary notice? When do I file the mechanic's lien after the notice?

Georgia

Our company received a call on a Friday evening about a underground water service leak. We gave a verbal quote, they received approval, they called with the approval, the owner and another employee went right over to begin work on the job. It was a major leak and deep underground. They worked both Friday eve and Saturday. The property management company that the work was done for contacted us via their attorney saying the price was too high. We responded with all of the above info in detail as to why the cost was what it was. Never heard from them again. Do we need to do a preliminary notice? And if so, when can we file the actual lien? Work was done on September 17th, 2021. Thank you so much! Susan

Morning Susan, thank you for reaching out.

Here is the information you need for filing a lien in the state of Georgia

My initial question is if you received anything in writing? Email, Text?

In Georgia the rules state that you don't have to send a prelim notice unless the owner filed a notice of commencement, however, that can be difficult to verify. Therefore, we suggest always sending one, just to protect your interests. You can send a free prelim notice here

Please let me know if I can help any further.
