Do I have the option to file a mechanics lien in Colorado after the 4 month deadline?

ColoradoMechanics Lien

I constructed two UPS Store Franchises and was never paid for labor from the owner. I am an employee of the same company. There is was no written agreement, just a verbal agreement.

I am sorry for the issues. If you missed the deadline to file, that is it. If you file now you risk being sued for removal of the lien. You can sue. If below $7500, small claims. From $7.5K to $25K, county court. Anything above that is the district court. If this is county court, the Colorado judicial branch website has excellent instructions, overviews, links and forms. The instructions, forms, and other resources are all available here https://www.courts.state.co.us/Self_Help/25000orless/ In addition to the above Colorado resources, Nolo Publishing has an excellent book that provides a plain English discussion of small claims. Here is the site http://www.nolo.com/products/everybodys-guide-to-small-claims-court-NSCC.html. Please note that the foregoing is not a representation that the information is all that one needs for your matter or a warranty on their accuracy. If you cannot afford a full representation, you should contact an attorney and consider having a limited representation. In this representation, the attorney provides specified services and they do not enter as the attorney of record in the case. This is normally less expensive and requires a smaller retainer. Our office and others offer limited representation. This is a brief overview https://bit.ly/3xY5VJS. I hope this helped answer your question and reach out to attorneys for a consultation right away.

To file outside of 4 months requires first filing inside of 4 months, in new constr., then you can get an extension to 4 months after completion of the finished project.
