Do I file mechanics lein?

Michigan

I'm a Electrical contractor , My customer is currently building his personal home ,Ive done business with him for many years . Great guy, unfortunately when he went on vacation last week he passed away. Sounds like there is no will or anyone to take care of these expenses . My guess is its going to probate. I have not completed the project, Its at a stand still . Currently I have $5100.00 invested. We where just out there last week working . Any help would be great to obtain my money . My plan was to use your services for the lein.

Yes I strongly suggest you file a CONSTRUCTION lien against the home within 90 days of the last date you worked at the site. It will be helpful if you have a written contract (not absolutely necessary) and an itemized bill for your services to date.

you should be ok finishing the job, then you would have 90 days from the LAST DAY YOU WORKED to file a Claim of Lien if necessary. lot of questions - anyone else live there? did he have wife or family? You need to check out exactly who owns the property. What county is this in? The above response is provided as a courtesy and does not establish an attorney-client relationship. If you would like to contact me directly for a consultation, I am located in Port Huron (810) 987-3970. Since 1975.
