Do crane rental companies need to be current holders of ROC license?

Do companies that rent equipment, such as cranes, to a construction contractor need to have a AZ ROC license?

If you furnish machinery to a job site, you must be licensed. However, if you are furnishing machinery to a contractor who will then use the machinery on the job site, then are not furnishing machinery to the job site but rather to a contractor and therefore you do not need a license. Another example is that suppliers that supply materials to suppliers that take those materials to the job site do not need to be licensed. The determining factor is whether you have charge or control of any part of the construction. If a company is just renting equipment it does not have charge or control of any part of the construction.

Maybe the laws have changed recently but I just ran into this same issue on a job and called the AZROC. They told me they do not have any requirements for a crane company to be licensed even if they are furnishing it to the site and doing the operating.
