customer demanding money before we could start the job

New YorkConstruction Contract

I had an agreement with a customer too install a vinyl fence for $13,000 with half down $6500 and the remaining $6500 due upon completion of the job. We got the down payment ordered the materials which aren't in yet, and now the guy is demanding his money back and we don't know what too tell him. He wants his money back and thats it nothing more he doesn't want us too do the work he just got impatient, there is no finish by date or anything and we tried too get him too realize that the order isn't in yet he wasn't hearing it and said "thats it im breaching the contract" what do we do about the money he wants back we don't have it as we already paid for the materials.

Termination of the agreement is pursuant to the contract. If there are no terms, the deadline is a "reasonable amount of time." It sounds like you should be able to proceed on the project of her forfeits his deposit. Feel free to contact me.
