Copy of Lease Louisiana with Preliminary Notices

LouisianaPreliminary Notice

We are an equipment leasing company. Our credit application includes our terms and conditions which is signed by the customer went he account is opened. Can we use this application on the preliminary notice rather than a copy of each individual lease for each piece of equipment?

Stacie,

I think it would depend on that document and whether it complies with the statuory requirments. Does it:

"provide notice that the lessor has leased or intends to lease movables to a contractor or subcontractor for use in the work. The notice shall include the name and address of the lessor, the name and address of the lessee, and a general description of the movables. If the notice is delivered more than thirty days after movables leased by the lessor are first placed at the site of the immovable, the claim and privilege of the lessor shall be limited to rents accruing after the notice is given."

If you would like for us to take a look at the document and provide a more detailed answer, we would be happy to assist you. 504-323-5885.
