Contractor's iicense transfer.

I have a corporate general engineering contractors license in California and have someone interested in purchasing my buisiness. If he does not have his own contracor's license can he work under my license for a certain amount of time or is there a procedure for me to transfer my licnese to him? Any other options?

Good afternoon! No, generally, the purchaser cannot "work under" your license. Does the purchaser have a license qualifer ready to go (whether a responsible managing employee or officer)? Does your business currently have projects underway? This can get sticky so I suggest speaking with an experienced construction attorney to make sure this is done correctly.

to own and operate a construction business, you are required to have someone in the company hold a contractor's license for the category of work that your company is performing. The license holder can either be a Responsible Managing Officer or a Responsible Managing Employees. There are technical requirements depending on the category that they hold which are a little bit detailed to list here. There are several strategies available for you to get what you would like accomplished. But, this is something that you would want to consult with knowledgeable construction attorney about in order to save yourself time and energy in dealing with the Contractor Board.

You can’t transfer your license to anyone else or let someone else use your license. The new owner will need to get their own license qualifier. You could stay on as the Responsible Managing Officer (RMO) or Responsible Managing Employee (RME) and continue to allow them to use your license, but only if you were staying actively involved in the new company and managing all of their projects . If the new company did anything wrong, you could lose your license. It’s safest for you to just sell them the business and let them get their own license qualifier.
