Contractor refusing to finish job

New York

Hi I have a contractor refusing to wrap up a job that was done. Fairly simple tasks that he has acknowledged through text to finish but will not finish. I received a letter from his attorney stating I was refusing payment but is false. I’ve reached out multiple times to both the attorney and contractor with no responses. Is there a length of time where the project is considered abandoned at this point? I’ve tried to reach out for weeks for resolution with no response. To this point I have not paid since payment was not requested until the job was completed. What are my options?

As you're aware, this is not a good situation for you, especially considering the attorney demand letter, more likely than not a lien will follow. To answer your questions, the contract needs to be reviewed along with any changes in scope. That attorney letter must also be reviewed. You probably need a construction lawyer to complete a preliminary review and/or assist you in resolving this dispute.

So, you need to assess the payment claims of the contractor. if they are bogus, terminate the contractor for abandoning the job and retain someone else to finish. Be prepare for liens and law suits from the terminated contract. You are going to an experience construction attorney at some point and the sooner you retain them the better off you will be. Good luck
