Contractor failed to finish job and wants final payment

I hired contractor to remodel kitchen. During remodel he overlooked that the drain for the sink needed to be lowered. Now that cabinets, countertop and sink are installed their is not enough room to hook up drain. He doesn’t want to do what is necessary to fix problem. So now I have a kitchen with no running water or functioning sink. Can I terminate our contract and use final payment to hire someone else to fix/finish job? I am not worried about lien because he did not provide me a disclosure notice.

I'd start off by giving him written notice of what needs to be done and why and telling him that you require his written commitment to timely complete the work as part of the contract or you will have to hire someone else to do the job as an offset to the contract or additional charge. RCW 64.50 sets forth required notices for construction defects. good luck
