After a clear termination of the contract, the contractor typically should not order more materials and charge you for those materials. Your written contract with the contractor should govern the contractor's rights and responsibilities in the event of termination. If the contractor has violated the contract, you could send a written demand for return of the deposit without deducting for the materials and file a lawsuit if the contractor doesn't comply.
