A few examples of common mistakes made by contractors when submitting applications for progress payments include:

  • Failing to provide a proper conditional waiver and release upon progress payment (e.g., using an incorrect through date, failing to incude amounts due to subcontractors and suppliers, failing to provide for appropriate exceptions for claims that the claimant intends to reserve);
  • Providing an unconditional waiver and release upon progress payment before the particular progress payment has cleared the financial institution on which the payment was drawn;
  • Failing to adhere to the contractual requirements for submitting applications for progress payments.

Of course, there are a lot more, but these are just three examples of common mistakes.
