CGC performing Electric and Plumbing without license of permits

FloridaRecovery Options

I hired a certified GC in Duval Co, FL, who is not licensed as a electrician or plumber. He did electrical and plumbing work, that had to be corrected and brought up to code because he acted outside his CGC license. The electrical work had to brought up to code as a result of GC doing electrical work without license, and GC is trying to charge me for the additional cost. Plumbing work has not been inspected, but covered up in one bathroom and is faulty. In this circumstance, is the CGC considered to be performing unlicensed contract work, so that my contract is now automatically unenforceable by law or by equity? Does GC still have any lien or bond claims/rights? I have paid the GC, so can I be awarded treble damages and force them to return the money I paid them under the contract? How should I proceed? Does a Certified GC have to be bonded? Are they required to carry property damage insurance so I can try to reclaim my money through their policy?

The scenario you describe is incredibly fact-intensive and you have provided only a small fraction of the facts necessary to answer your questions. The only way to obtain competent advice is to engage an attorney to review your situation and advise you as to your rights and remedies. I can tell you that GCs are not required to be bonded and whether they carry liability insurance and the amount of coverage is a matter determined by the terms of your contract with your GC.
