Cancel contract with Architecture t& Refund money

I was at the staring for my home improvement project. I had signed the contract with my Architecture to prepare the plan & get approval from city. I had paid the 40% money in advance $4000. He had made 3 visits in city but not able to get approval. After that COVID 19 situation came up. Due to this COVID 19 situation, I do have of safety & economic concerns. My wife has week immune system and due to financial constraints I am not in the potion to move this project forward. I have requested to my Architecture to return the partial money back bit he has total refused to give any % on money back. I would like to if i can get back a portion of my advance $4000. Please advise.

Your contract should govern the ability to recover any of your deposit upon termination of the contract. If the architect has not performed work for the value of the $4000 retained, then you should be entitled to a refund. The architect should give you an invoice to notify you of the work already performed and the alleged value of that work. If you haven't received one yet, make a demand in writing for an invoice. If the architect hasn't performed $4000 worth of work, depending upon the terms of your contract, you would have a good claim to assert in small claims court. That would be the most efficient given the amount at stake.
